Understanding your tax status

In Ireland, your tax status is determined by your residence, ordinary residence and domicile, and your tax obligations will vary accordingly. We work closely with you and your tax advisors to establish your tax position and ensure it is appropriately reflected in your financial planning. A clear understanding of your tax status is essential when considering investment structuring, estate and succession planning, and the management of cross-border income and assets.

TAX STATUS DEFINITION HOW IT'S DETERMINED
Tax Residency Determines if you are considered a resident for tax purposes in a given year
  • Spend 183 days in Ireland a tax year, or
  • Spend 280 days over two consecutive years (min. 30 days in each year)
Ordinary Residency Based on long-term presence in Ireland
  • Be tax resident in 3 consecutive years, become ordinarily resident in year 4
  • Lose status after 3 years of non-residency
Domicile Refers to your permanent home or long-term intention to reside
  • Acquired at birth (domicile of origin)
  • Can change only with clear evidence of permanent relocation
Remittance Basis Special tax treatment for non-domiciled residents
  • Available if you are Irish tax resident but not Irish domiciled

Helping you achieve your goals

Ireland offers an attractive lifestyle for retirees, but building a pension locally may not always be the most tax-efficient strategy for foreign nationals. Depending on your circumstances, transferring retirement assets to another jurisdiction may provide greater flexibility and tax efficiency. We provide specialist advice on cross-border retirement planning. Our team can assess the options available to you, explain the associated regulatory, tax and currency considerations, and guide you through the transfer process where appropriate. Our aim is to help ensure your pension arrangements are structured in a way that supports your long-term financial plans, residency status and retirement objectives.

In some cases, transferring Irish retirement assets to other jurisdictions, such as Malta, which offers pension structures recognised under multiple tax treaties, may provide greater flexibility and tax efficiency. For clients with UK pension benefits, we provide specialist advice on available options, including the transfer of UK pensions to a Qualifying Recognised Overseas Pension Scheme (QROPS) where appropriate. We guide you through the full process, from assessing the suitability of a transfer and explaining the regulatory, tax, and currency considerations, to liaising with UK providers and coordinating the transfer. Our aim is to ensure your pension is structured in a way that aligns with your long-term financial plans, residency status, and retirement objectives.

Navigating the complexities of international succession planning requires a strategic approach that accounts for diverse tax regimes. We work closely with your trusted tax professionals to ensure your estate plan is structured to support tax efficiency and preserve wealth across generations and jurisdictions.

We provide exptertise in the development of investment strategies tailored to our international clients' tax position, goals, risk tolerance and preferences. Through a dedicated investment advisor, access to our financial planning and technical teams, and myDavy, our digital portal, we provide ongoing support to help clients remain informed and confident in their financial decisions. For US-connected investors, we also help navigate complex US tax considerations, including Passive Foreign Investment Company (PFIC) rules. We design and manage portfolios that align with relevant US tax requirements while complying with European regulatory standards, helping clients invest efficiently while managing compliance considerations.

Individuals who are Irish tax resident but not Irish domiciled may benefit from specific tax treatment on foreign income and gains. Davy offers a tailored non-domiciled investment platform designed to meet the needs of internationally mobile clients and help them make the most of available opportunities.
