Some five years on from the initial The Stars Group (TSG) Kentucky legal proceedings, the State Supreme Court has reinstated an award of damages, which would equate to c.$1.5bn liability for Flutter. It is surprising to see a judgement previously referred to by an appeals court as an “absurd, unjust result” upheld. Equally, the suggested fine appears highly disproportionate to the c.$18m gross gaming revenues generated in the state during the relevant period. There are several legal options available to the group, and it expects any ultimate liability to be “a limited proportion” of the reinstated judgement.
